Babbitt v. City of San Leandro

Plaintiff, an African American 50 year-old, was sitting in his vehicle when approached by police about an open alcohol container in a parking lot. Plaintiff denied knowing anything about it and refused to allow a search of his vehicle. Plaintiff was placed in a chokehold and arrested. Toxicology revealed no alcohol in his system. Defendants City of San Leandro and Officer Michael Olivera settled prior to filing any motions.

Eric Garner v. NYPD

Death of 43 yr. o. man following being placed in chokehold and left in prone position while being arrested for selling loose cigarettes. Survived by wife and children who appear to have settled prior to filing lawsuit. No charges brought against officers.

Hunt v. City of Cleveland

Police officer crashed patrol car into plaintiffs’ car during high-speed pursuit of someone else; plaintiffs were a 46 y.o. Af-Am male janitor (with alcohol in his system) and 50 y.o. Af-Am female, unemployed. Both sustained multiple fractures and injuries requiring surgery. Alleged cover-up. Verdict includes $1,000,000 punitives against officer.
