Claimant-Respondent seeks the upholding of the Court of Appeals' affirmation of the Yamhill County Circuit Court's finding that civil forfeiture in Oregon constitutes criminal punishment for the purposes of Double Jeopardy under the Fifth Amendment due to its punitive nature. Our brief argues that overturning the lower court's decision and accepting Plaintiff-Petitioner's arguments in support of civil asset forfeiture will strip Oregonians of their protections against civil asset forfeiture, promote a harmful "policing for profit" model, and harm individuals--particularly Black and brown people and poor people--without advancing any legitimate government interests.
