Vacating and amending J.K.J. v. City of San Diego, 17 F.4th 11247 (9th Cir. 2021), previously reported in Actionable Conduct on Nov. 23, 2021. (person arrested following stop for expired vehicle registration overdosed on drugs and died, had vomited, but denied withdrawing or detoxing, stated she had not eaten anything, stated she was sick, her stomach was turning, and she was pregnant, and officers found no drugs in her car; court affords officers qualified immunity concluding cases cited by plaintiff did not clearly establish right allegedly violated on denial of medical care claim; court concludes plaintiff did not present deprivation of life without due process claim in district court; district court properly took video into account and did not give it excess weight; dissent on denial of medical care claim by Judge Watford; court notes a further petition for review en banc may be filed.
